Once citizens have found the records that they are searching for, if applicable, they can post bail. The following section provides more details on the bail process in Comal County.
How Do I Post Bail & Get Someone Released From Jail in Comal County?
If any citizen has been accused of a crime, they will have to spend all their time in jail until all the court meetings have passed. However, they can also post bail bonds. This allows them to be freed from jail until they have to show up in court.
It should be noted that there will be conditions on the bail which must be met. If not, the citizen will be arrested again.
In Comal County, there are three types of bonds available:
- Cash Bond
- Surety Bond
- Personal Bond
A cash bond is made by signing a contract which ensures that the defendant will turn up in court. As long as the defendant appears in court, they will receive their money back by the end of their appearances.
Similarly, a surety bond works the same way but involves a bail bondsman, too. In this case, the accused suspect pays a certain amount to the bail bondsman.
In turn, the bondsman will pay the full bail amount, which will be returned as long as the suspect appears in court. If the suspect fails to show up in court, the money will not be returned and the suspect will have to pay the bondsman for the losses incurred.
Lastly, a personal bond is also a contract signed between the court and the suspect. As a result of this contract, the suspect is released based on a recognizance. However, if the defendant fails to show up in court, then they will have to pay the full amount of the personal bond.
The Comal County Sheriff’s Department also has a FAQ (Frequently Asked Questions) page regarding bail bond matters which can be referred to for more information.8
Suspects can purchase their own bail bonds as long as they have the money to match the cash amount set. Similarly, someone else can also add funds into the suspect’s inmate account. It should be noted that payments for all cash bonds are accepted through a check or a money order, only.
Citizens can also get help from a bail bondsman. These workers will evaluate the suspect’s case to figure out the bail will be written. These are some factors which the bondsman will look at before writing the bond:
- Employment Description/History
- Criminal History
- Family Ties
- Ownership Of Home
- Length of Time the Suspect Has Lived in the County
In return for their services, the bail bondsman will take around 20% of the cash bond amount. After the court dates are completed, suspects will have no more costs to incur.
When a bail bond is set through a bondsman, there is a short period of time for the suspect to show up in court. If they do not, then the suspect will have to pay the whole bail amount.
In order to buy a bail bond, suspects will have to fill the bail bond form that is available through the Comal County Bail Bond Board.9 There is also a rules and regulations document that citizens can go through to learn more information. Similarly, searchers can also reach out to the bail bond secretary using the following details:
Bail Bond Secretary
150 North Seguin Avenue,
New Braunfels, TX 78130
Phone: 830.643.3805 or 830.620.3450 ext. 2011
Email: [email protected]
The information for all payments are mentioned and signed within the bail bond form. This is decided upon by the person that is writing the suspect’s bond.
Similarly, the same process is followed in New Braunfels. Suspects looking for a bail bondsman can find several third-party services that are approved by the county.
